This guide explains how probate and guardianship cases actually move through the Tenth Judicial Circuit in Polk County: the Bartow courthouse, the 4-series administrative orders currently in force, and the local rules — some dating to the 1990s and still binding — that shape how estates and guardianships are administered. Every order cited links to the court’s official PDF.
Polk probate lives at the county seat: Polk County Courthouse, 255 N. Broadway Avenue, Bartow, FL 33830 — (863) 534-4000, polkcountyclerk.net. Lakeland and Winter Haven are the population centers, but the case is filed and heard in Bartow. Original wills are brought to the Bartow office; hearings are not scheduled until the death certificate and original will are on file, so obtaining certified copies early controls the calendar here more than anywhere else in the region.
Two Polk orders create local practice that surprises out-of-county counsel:
These are the 4-series (probate chapter) administrative orders currently published by the Tenth Judicial Circuit. Each links to the official PDF on jud10.flcourts.org.
| Order | Subject | What it does |
|---|---|---|
| AO 4-1.2 | Recording of probate documents | Requires certain probate documents to be recorded in the official records of the Clerk. |

| AO 4-7.5 | Guardianship education for non-professional guardians | Implements § 744.3145: 8 hours of instruction for guardians; 4 hours for a parent serving as guardian of a minor child’s property. |
| AO 4-8.0 | Bank authority on presentation of Letters | Banks may allow a guardian or personal representative access to the safe-deposit box on Letters alone, without a further court order. |
| AO 4-9.1 | Protection of guardianship funds | Ward funds headed to a § 69.031 designated depository are first paid to the guardianship attorney’s trust account. |

What each order actually requires, in plain terms:
The circuit’s comprehensive guardianship manual, written expressly as a reference “for guardians, attorneys, staff, and the public.” Key requirements:

Every appointed non-professional guardian must complete 8 hours of approved instruction and training; a parent serving as guardian of the property of their own minor child needs 4 hours (§ 744.3145). Courses must be court-approved — budget for this at appointment, not at the first annual report.

Entered because area banks were refusing to honor Letters, this order authorizes any financial institution, on presentation of Letters of Guardianship or Letters of Administration, to allow access to the ward’s or decedent’s safe-deposit box for lawful purposes without further order of the court. If a Polk bank balks, this is the order to hand them.

A Polk-specific safeguard in force since 1994: liquid assets belonging to a ward that are to be placed in a designated financial institution under § 69.031 are first paid only to the trust account of the guardianship’s attorney, who is then responsible for depositing them with the designated institution. Counsel — not the guardian — is the required conduit for ward funds in Polk.

Appoints the circuit’s general magistrates for probate, guardianship, mental-health and public-health dockets — including Baker Act commitment hearings under § 394.467 and Marchman Act treatment under § 397.681. As elsewhere, magistrate review is frequently the faster calendar for routine guardianship compliance.

A short but decisive assignment order: all mental-health cases in the Probate Division go to Section 17, except risk protection cases, which go to Section 31. Combined with the practice of hearing probate in Bartow, this tells you which section — and therefore which calendar — a Polk mental-health matter lands on from day one.

The Polk County Courthouse in Bartow — the county seat — even though Lakeland and Winter Haven are the larger cities. Original wills are brought to the Bartow Clerk’s office.
Not until the death certificate and the original will have been filed — so ordering certified death certificates early is the single biggest schedule saver in Polk.
Under AO 4-9.1, liquid ward assets headed for a designated depository are first paid to the guardianship attorney’s trust account — the attorney, not the guardian, is the required conduit.
